NEWPORT NEWS, Va. (WAVY) — A 48-year-old man is accused of biting an officer, spitting in the officer’s face and threatening to kill the officer while being taken into custody early Wednesday morning.

Newport News police say they were called to the 300 block of Charles Street just after midnight for a report of a disorderly incident.

When they arrived, a woman said she was assaulted by Dale Spratley, who lived at the residence, but she did not want to press charges.

Police say when they talked to Spratley he smelled like alcohol and became verbally aggressive with them. They advised him to stay inside the house or he would be arrested for public intoxication.

Shortly after leaving, police say they were dispatched back to the home. Spratley was outside of the home when they arrived, against their earlier warning.

According to police, they told Spratley he was under arrest and that is when he bite one of the officers, spit in his face and threatened to kill the officer.

Spratley was taken into custody and charged with two counts of assault on law enforcement, obstruction of justice and intoxication in public.
