Man gets 37 years in infant daughter’s death

JAMES CITY COUNTY, Va. (WAVY) — A man charged in the death of his infant daughter is now facing more than three decades in prison.

Bryan Timothy Arruda entered an Alford plea in May for the death of 3-month-old Emery Alaine Arruda. The plea meant Bryan Arruda did  not admit guilt in the case, but acknowledged there was enough evidence for a likely conviction. 

Emery was found injured at a home in 2017 and was flown to VCU Medical Center in Richmond, where she later died. 

Bryan Arruda was sentenced Monday to 40 years in prison, but had three years suspended — leaving 37 years to serve. He is also facing 50 years of supervised probation following that term.
