Former Virginia Beach school board member will not be reinstated ahead of trial

VIRGINIA BEACH, Va. (WAVY) — A former Virginia Beach School Board member will not be reinstated until the outcome of his residency trial.

Joel McDonald represented the Rose Hall area before he had to give up his position on the board earlier this month.

10 On Your Side was told McDonald moved out of the Rose Hall district. State law requires school board members to live in the area they represent.

The board filed a petition to declare McDonald’s seat vacant.

Attorney Kevin Martingayle said earlier this month McDonald has since moved back to Rose Hall.

The Virginia Beach City Charter states if you are going to run for the school board, you have to declare whether you are running for the district, or at-large. It also states everyone gets elected at-large.

WAVY’s Andy Fox reports a judge decided McDonald will not be reinstated until the residency issue is resolved. McDonald’s trial date has been set for April 11.
