VIRGINIA BEACH, Va. (WAVY) — Prosecutors withdrew charges against one of the suspects accused in a July 4 double shooting at the Virginia Beach Oceanfront.
Sherwin Tann was facing charges of felonious assault, use of a firearm, possession with the intent to distribute marijuana and receipt of a stolen firearm.
Tann and a juvenile were accused shooting one man in the leg and grazing another following a fight. It happened near a Best Western hotel at the Oceanfront.
A spokesperson with the Virginia Beach Commonwealth’s Attorney’s Office said the charges against Tann were nolle prossed –or withdrawn — because an eyewitness needed to prove the case passed away.
Prosecutors are deciding whether they will be able to bring charges back.
An investigation into the shooting is ongoing.
