VIRGINIA BEACH, Va, (WAVY) — Another former Virginia Beach council candidate is contesting the election in the Beach district, arguing another special election should be held between qualified candidates.
Richard “RK” Kowalewitch, who came in third in the race for the Beach council seat is accusing Councilman-elect David Nygaard of not being qualified to hold the seat. It echoes a lawsuit filed by Councilman John Uhrin last week that accuses Nygaard of falsely claiming to have lived in the Beach District when qualifying for the election. Both ask for the judge to declare Nygaard not qualified to hold the seat.
The difference lies that while Uhrin asks to fill the seat as runner-up, Kowalewitch argues “it will require a special election that Richard W. Kowalewitch and John E.Uhrin will be the only candidates as they were the only two qualified candidates in the November election for this seat.”
This isn’t the first time Kowalewitch has taken action on the issue. Over the summer he asked the Virginia Beach Commonwealth’s Attorney to look into the issue.
On October 1, Commonwealth’s Attorney Colin Stolle wrote to the Director of Elections that “at this point, I find there is insufficient evidence to prove that a crime has been committed.”
The Beach race is also currently under recount.
