RICHMOND, Va. (AP) — With his accuser sentenced for perjury, a Virginia man who was imprisoned on false sexual assault charges now wants his name cleared.
Attorneys for Johnathan Montgomery and the attorney general's office are asking the Virginia Court of Appeals to speed consideration of his petition for a writ of actual innocence.
The Richmond Times-Dispatch (http://bit.ly/1d2KhcD ) says the petition was filed Wednesday in Richmond.
Monday, Elizabeth Paige Cost was sentenced to two months in jail for fabricating a sexual assault that led to Montgomery's conviction and 7 ½-year prison term. The two had been neighbors in Hampton.
Montgomery served four years in prison before Coast admitted her lie.
