VIRGINIA BEACH, Va. - The Commonwealth's Attorney has decided not to file chargesagainst the driver of an SUV involved in a deadly bicycleaccident.
At around 5:45 a.m. on April 19, 54-year-old Daniel Wayne Hershof Virginia Beach was killed when his bike collided with the SUV inthe 3000 block of Shore Drive near the Starfish intersection.
The Ford Explorer, driven by a female, was traveling eastboundon Shore Drive when the right side of her vehicle struck Hersh.
He was transported to an area hospital and was pronounced deadat approximately 9:00 a.m.
The Commonwealth Attorney says there is no evidence the driverviolated any criminal statute.
