PORTSMOUTH, Va. (WAVY) - The case of the missing Portsmouth man that seemed to present more questions to answers took another turn today.
According to Bill Prince with Portsmouth Police, Circuit Court Judge Kenneth R. Melvin granted a petition in Portsmouth Circuit Court today that James Kenneth Britt has been declared dead.
This follows a civil proceeding where Britt's mother sought to have her son declared dead.
James Britt's brother, William, told WAVY.com in June that the incident brought great stress to his mother.
"It totally is destroying my mom. My mother is down to 70 pounds and she has to go in for an operation next month for her heart," he said.
James Britt went missing in April and red stains were found in his Portsmouth residence.
