Judge may overturn murder conviction of former Nav

VIRGINIA BEACH, VA.(WAVY.com) -- On June 25, we could know if a Virginia Beach judge thinks the confession of Billy Joe Brown as the person solely responsible for a Georgia college student's death is credible.

Brown, who was convicted in the murder of Jennifer Evans along with his Navy SEAL swim buddy Dustin Turner, has had a change of heart since his religious conversion.

At a special hearing for a writ of innocence filed by Turner's attorney, Brown testified he choked Evans to death after a night of heavy drinking.

Turner is hoping Brown's latest statements will convince a judge to let him out of prison.

Turner's mother Linda Summit says, "Dustin has maintained his innocence the whole time because he is innocent."

Evans' family says throughout the course of the two day hearing, it appears the consideration of their daughter as a victim in all this was brushed aside. Delores Evans, Jennifer's mother, says for the family there is no closure, not when you think of what could have been.

"Not being able to see Jennifer graduate from college, get into med school, get married or have children which would give us grand children," said Evans' mother.

Evans wanted to be a doctor and next month marks the 13th year since she was killed.
