VB race still undecided, court steps in

VIRGINIA BEACH, Va. - The legal wrangling continues as the 21st District House race remains officially undecided.

Republican Ron Villanueva leads by 16 votes over incumbent Democratic Delegate Bobby Mathieson.

Lawyers for both sides admit the matter appears to be headed to court.

On Thursday, a judge ordered election officials to stop canvassing Tuesday's votes. Mathieson claims more than 300 absentee ballots are "unaccounted for." He wants a judge to intervene.

Meantime, Villanueva's attorney contends he wasn't notified of the court order beforehand and has asked for inclusion in any future related hearings.

After each election, the city's Electoral Board meets to review ballot logs, and check paperwork from precincts to certify winning candidates. That process is now at a standstill because of the court order.

Mathieson's attorney sent letters to election officials Friday asking for paperwork pertaining to those absentee ballots and has issued a Monday morning deadline for them to comply.
