No charges in deadly bicycle accident

The Commonwealth's Attorney has decided not to file charges against the driver of an SUV involved in a deadly bicycle accident.

At around 5:45 a.m. on April 19, 54-year-old Daniel Wayne Hersh of Virginia Beach was killed when his bike collided with the SUV in the 3000 block of Shore Drive near the Starfish intersection.

The Ford Explorer, driven by a female, was traveling eastbound on Shore Drive when the right side of her vehicle struck Hersh.

He was transported to an area hospital and was pronounced dead at approximately 9:00 a.m.

The Commonwealth Attorney says there is no evidence the driver violated any criminal statute.
