NORFOLK, Va. (WAVY) - A judge could soon decide the fate of two Waterside bars, Have A Nice Day Cafe and Bar Norfolk.
The city closed the businesses down last week for selling alcohol without a city issued permit, or so-called special exception.
During a hearing on Tuesday an attorney for the city said what the bars did amounted to "a vigilante approach to the law." The bars operated within hours after the City Council voted to revoke their ability to serve liquor.
But attorneys for the bars argue the establishments were well within their rights to operate because their alcohol license is issued by the State ABC Board, and the bars had no prior knowledge of City Council's plans.
The hearing is expected to continue on Wednesday as the judge plans to take up two lawsuits filed by the bars and the city over their shutdown.
About a 120 people are employed by Bar Norfolk and Have A Nice Day Cafe.
