VB man charged in NY eatery shooting

ROCHESTER, N.Y. (AP) - Authorities say a Virginia man has been charged with wounding a woman inside a late-night restaurant in Rochester soon after police arrived to investigate a report of a man with a gun.

Police tell local media outlets that officers were already inside Gitsis Texas Hots around 3:15 a.m. Sunday when they approached 30-year-old James Harvey of Virginia Beach after being told he had a gun.

Officials say Harvey fired once, wounding the 31-year-old victim of Fairport in the lower body. She was reported in stable condition at Strong Memorial Hospital in Rochester.

Harvey was arrested at the scene. He was charged with assault and criminal possession of a weapon.

Officials say Harvey and Walker didn't know each other.
