VIRGINIA BEACH, Va. (WAVY) - The high school driver involved in a drunk driving crash last week in Virginia Beach faced a previous illegal possession of alcohol charge.

Police charged Carter Womick with DUI and illegal possession of alcohol in the June 16 crash on Revere Drive in Salem Woods. His passenger, 15-year-old Meaghan Gerety, remains in critical condition. 10 On Your Side discovered Womick faced a judge nine days prior for a similar charge.

Womick was caught with alcohol on April 20, just two months prior to this accident. He was in court on that charge June 7.

According to court documents obtained by 10 On Your Side, Womick waived his right to an attorney and pleaded guilty to illegally possessing alcohol.

According to Virginia State Mandated Code, the offense carries a mandatory six month loss of license and 50 hours of community service or a $500 fine.

Instead, the judge gave Womick a deferred sentence. He was put on community corrections probation and the case was continued until June 7, 2012.
