PORTSMOUTH, Va. (WAVY) - A federal judge made a major decision in a wrongful death lawsuit involving a Portsmouth police officer. A judge ordered State Police to release investigative records to the victim's family's attorney.

Kirill Denyakin, a cook at the Renaissance Hotel, was killed by a Portsmouth police officer in April. He was 26 years old.

Police were responding to a report about an intruder when they found Denyakin. They said he lunged toward an officer who fired his weapon 11 times.

Police later said he didn't have a gun.

Now, the family is filing a $22 million wrongful death lawsuit against the department.
