PORTSMOUTH, Va. (WAVY) - Thursday, a grand jury did not indict a Portsmouth police officer involved in a deadly shooting.
In April 2011, police were responding to a report about an intruder when they found 26-year-old Kirill Denyakin, of Kazakhstan.
Police say Denyakin did not follow police commands and lunged towards an officer. The officer, in turn, fired his weapon 11 times.
Police later said Denyakin didn't have a gun.
The Commonwealth's Attorney told 10 On Your Side the grand jury's decision will end the criminal investigation.
The victim's family is filing a $22 million civil lawsuit against the Portsmouth Police Department.
