PORTSMOUTH, Va. (WAVY) - A Portsmouth officer cleared criminally in the fatal shooting of Kirill Denyakin will now face a jury in a civil trial.
A judge ordered the civil trial to determine whether Officer Stephen Rankin used excessive force when he shot Denyakin 11 times in April 2011.
On April 23, 2011, Rankin responded to a report of a burglary in progress and found 26-year-old Kirill Denyakin, of Kazakhstan.
Rankin says Denyakin did not follow police commands and lunged towards him in a threatening manner. An attorney representing Denyakin's estate contends Denyakin was too intoxicated to do so.
Police later said Denyakin wasn't armed.
Last week, a grand jury decided not to indict Rankin, ending the criminal investigation.
A date for the civil trial has not been set.
