NORFOLK, Va. (WAVY) - Norfolk Circuit Court Judge Karen Burrell blocked Carlos Howard's plea to dismiss orders to close his business. The funeral home is to remained closed till March 8.
This injunction hearing comes after Burrell's ruling last week to keep his business open until a hearing on March 8, according to Anthony Fuller with Norfolk Circuit Court, Civil Division.
The state's Board of Funeral Directors and Embalmers suspended Howard's license claiming Howard violated numerous state codes when preparing the body of a murder victim .
An injunction was granted Jan. 20 for Howard to continue working at his business, but to not accept any new bodies. That injunction ended at 2:30 p.m. Jan. 27.
Howard called WAVY TV 10 Friday evening denying the remains were ever improperly prepared and added the embalming case report will attest to that. Lastly, the funeral home owner said the board abused their power by using the administrative process act to not allow him his due process.
