Hamilton bankruptcy plan heads to court

NORFOLK, Va. (WAVY) - A federal bankruptcy judge is considering whether to accept a former Virginia lawmaker's plan to repay nearly two dozen creditors.

Former Delegate Phil Hamilton and his wife, Kim, filed for Chapter 13 bankruptcy in February. They submitted the plan to repay 22 creditors in March.

The Daily Press reports that the U.S. trustee assigned to the case is objecting to the repayment plan . Michael Cotter says in a court filing that the plan is underfunded and won't pay out as it proposes.

U.S. Bankruptcy Judge Frank J. Santoro is expected to rule on the plan Friday.

Hamilton's criminal trial on bribery and extortion charges is scheduled to begin next week.
