NORFOLK, Va. (WAVY) - Today, a judge’s decision came down on a motion that was brought before the court, weeks ago.
The felony homicide charge for 47-year-old Tammy Futrell was dropped today, according to Commonwealth's Attorney spokeswoman Amanda Howie. Felony child neglect charges remain in play.
Seven-week-old Dylan Cummings died on May 25, 2010 . Cummings was in the care of Tammy Futrell at the Little Eagles Day Care on East Little Creek Road at the time of his death, Howie told WAVY.com in 2010. The day care was operated by Bethel Temple Church of Deliverance and considered a religious-exempt facility, which are often exempt from licensure.
