HAMPTON, Va. - There will be no additional charges filed relating to the death of Theo Smalling, the Hampton University basketball player who was shot in the early morning hours on Saturday, October 24, 2009. Smalling died a few days after the shooting.
Investigators say Smalling and two of his friends pulled up to Fusions nightclub off of Mercury Boulevard, when 21-year-old Dominique Smith "mishandled a gun" and accidentally shot Smalling in the stomach.
Dominique Smith is charged with one count of Reckless Handling of a Firearm.
According to police, the investigation did not uncover any evidence of conduct so gross and culpable as to indicate a callous disregard of human life, which would be necessary to support a manslaughter charge.
Police have discussed the findings with Smalling's parents, who said they're satisfied with the outcome of the investigation.
