CHESAPEAKE, Va. (WAVY) - A former Chesapeake assistant principal will stand trial a second time for his wife's murder in Amherst County in 2007.
In April, Wesley Earnest was convicted of the first-degree murder of his wife, Jocelyn Earnest, after nine days of testimony and a final day of deliberation.
In July, the judge declared a mistrial, after jurors admitted they saw evidence they weren't supposed to see.
The second trial of a former high school administrator accused of killing his wife has been moved from Bedford County to Amherst County.
While the trial will be held in Amherst County, the jury will be comprised of Nelson County residents.
Jocelyn Earnest graduated from West Virginia University and was a member of the Mountaineer women's basketball team.
Westley Earnest was the assistant principal at Great Bridge High School in Chesapeake.
His retrial is set for November 8.
