VIRGINIA BEACH, Va. (WAVY) - A Chesapeake mother has been charged with DUI and felony child neglect for allegedly driving drunk with her three week old baby in the back seat.
Heather Maiers, 28, was stopped by police last Thursday on Oceana Boulevard in Virginia Beach shortly after 11 p.m. Police say Maiers was speeding in her van driving 50mph in a 35mph zone and when the officer approached Maiers' van, he saw her newborn baby in the car with her.
According to court records, a magistrate noted, "While [the] officer was telling her her license was suspended she said if one of her children needs something, she will drive." The magistrate also remarked that Maiers was "rude and insulting."
A blood alcohol test showed Maiers had a .13 blood alcohol content, which is higher than the legal limit of .08.
Maiers, who was noted in court records to be a stay-at-home mother with a master's degree , has been arrested for DUI before. She was convicted of drinking and driving in 2006. Court records show Maiers, who lives with her husband and other children, was charged Thursday with DUI-Second Offense within 5 Years and also Felony Child Neglect.
She bonded out of jail and is due back in court on October 7.
