The importance of a legal will

NORFOLK, Va. - Do you have a will? It's a simple question, that Attorney Michelle Parker says too many people answer 'no.'

"Your will is your last chance to express your wishes...with regard to the distribution of your property and more importantly who has custody of your minor children," Parker told WAVY.com.

Even if you don't have children or aren't married, Parker says everyone old and young should have one.

"You never know. I mean what we've been seeing in the news lately so many people are passing and nobody anticipated it," Parker said.

Money aside, Parker says if you have anything of sentimental value that you would want to have a say in how it's distributed after your death, you should have a will.

Parker advises also naming an executor to the will. "This is a person that's going to be responsible for carrying out your wishes and this is somebody that you find is trustworthy and dependable," Parker said.

It could be a best friend or sibling, and it doesn't need to be a lawyer.

While you can write a will on your own, Parker suggests getting an attorney to help. "The attorney is there to make sure all the i's are dotted t's are crossed," Parker added.

Parker says the cost is $200 and up - a small price when you think about what your family could wind up spending in attorney's fees if you don't have one.
