CHESAPEAKE, Va. - A 3-year-old little girl was hospitalized last week after her mother's boyfriend allegedly beat her. The little girl, Alayah Mahone, died at the hospital four days later, police said Tuesday.

Leon Lamar Surgeon was originally behind bars charged with Aggravated Malicious Wounding and Felony Child Abuse, but Tuesday police secured a warrant for a 1st degree Murder charge against him.

Police and medics discovered Mahone unresponsive in a home in the 3400 blk. of Clover Meadows Drive at around 8 p.m. Wednesday, October 28. Mahone was taken to Maryview Hospital, then transferred to Children's Hospital of the King's Daughters in Norfolk, where she was later pronounced dead from injuries sustained in the alleged beating. Police say Mahone suffered severe head trauma.

Surgeon is currently being held at the Chesapeake City Jail.
