Teen to remain in jail for girl's death

CHESAPEAKE, Va. (WAVY) - A 13-year-old boy accused of a shooting that left a 12-year-old girl dead will remain in jail.

Police said the 13-year-old got the gun from another child, who obtained the gun without his or her parent's knowledge.

The boy, a sixth grader at Deep Creek Middle School, is charged with manslaughter in the death of Carolyn Walker. There are no further charges pending at this time.

Police say the boy shot Walker near her home Jan. 10. Family members have said the boy was playing with the gun.

Both the mother of Carolyn Walker and the mother of the accused killer stood beside lawyers Wednesday morning.

The defense asked that the 13-year-old be released and put under house arrest until the trial later this month. The judge denied that request.

The defense said the boy has been "soft spoken about the incident" while in jail. The defense also requested a mental health evaluation be completed before the trial begins. The boy will not be tried as an adult, as state law requires the defendant to be at least 14.

His mother said she is going to take a leave from work, so she can be there to provide for him.

Cameras were not allowed inside the courtroom as the 13-year-old appeared by video conference.

The trial is scheduled for Feb. 21, 2012.
