CHESAPEAKE, Va. (WAVY) - The 13-year-old boy accused in the shooting death of a 12-year-old girl will remain in police custody.

Tuesday, a judge denied a request for the teen to be released, citing safety concerns for the suspect.  In addition to his manslaughter charge, the teen now faces a possession of a firearm by a juvenile charge.

On Jan. 10, Chesapeake police were called to the Owens Village Apartment Complex on Geneva Avenue for reports of a young girl suffering from a gunshot wound. Carolyn Walker, 12, was pronounced dead at the scene.

According to police, the boy shot Walker. Police told WAVY.com the gun was obtained from another child, who took the weapon without their parent's knowledge.

Two motions were also filed on Tuesday, a motion to suppress and a motion to have the gun analyzed for fingerprints.

A continuance was also granted with a trial date set for May 15.

Walker's mother, Lisa Walker, told WAVY.com, " I know the judge made a wise decision...We have no control over the community and what may happen to him." In a previous interview with WAVY.com, Lisa said the two children were friends.

Lisa now wants to try and make a difference in the lives of young people.

"With the speeches, I will be going to different schools. I thank God for giving me the strength and the courage to keep moving on here, because that's what Cee Cee would like for me to do," she continued.

A detention review hearing will be held for the suspect on March 13.
