Driver fined in crossing guard death

CHESAPEAKE, Va. (WAVY) - The driver accused of hitting and killing an on-duty school crossing guard has been convicted in court Wednesday morning.

Crossing guard Lovette T. Person, 35, was hit by a Toyota Tundra driven by Tiare L. Blees, 32, outside Western Branch Intermediate School in Chesapeake on Oct. 3.

Person was at the intersection of Brittany Way and Terry Drive directing traffic. She was wearing a reflecting vest.

Lynetta Heath, Person's mother, told WAVY.com, "We lost my daughter, and we're suffering dearly behind it. As far as the case goes, I don't think it was a fair case."

Police said Blees may have been distracted by the sun. Blees was due in court on Nov. 14, but did not show up for the arraignment, so the judge ordered a warrant for her arrest.

Wednesday morning, Blees was convicted of an improper driving charge, which is a traffic offense. She was ordered to pay a $250 fine.

"I am sincerely sorry," Blees said in court. "I apologize. I wish I could take that back."

WAVY.com spoke with Blees' attorney, Michael Sweeney, who said his client was in counseling. Sweeney said, "This is a tragedy for both families, and my client is extremely remorseful."

Person's family has also filed a lawsuit against Blees for $6 million.
