VIRGINIA BEACH, Va. (WAVY) - A 33-year-old Virginia Beach man was found guilty Wednesday for a 2011 home invasion.
According to Macie Pridgen with the Virginia Beach Commonwealth's Attorney, the jury recommended Torrey Lavell Washington be sentenced to 39 years in prison and pay a fine of more than $5,000.
Pridgen said Washington and an unknown accomplice forced their way into an apartment in the Harpers Square complex Oct. 2, 2011. Two adults and two children were asleep at the time.
Washington acted as a look out while his accomplice forced the family to the ground at gunpoint.
The two men got away with cell phones, money and a gun. Washington's case was declared a mistrial last June and was retried this month because the jury couldn't reach a verdict.
Washington had previous convictions for possession of a controlled substance, trespassing, assault and battery of a family member and indecent exposure.
He was charged with abduction and use of firearm for the October 2011 incident.
Washington will be sentenced April 17, 2013.
