NORFOLk, Va. (WAVY) - A man arrested and jailed for an August 2012 murder inside of a Norfolk Rite Aid has been released.
Bernell Benn, 41, was arrested Aug. 16 for the shooting death of 42-year-old Ramon Colorado in the 3600 block of Tidewater Drive while the two were waiting in line at a drugstore.
A $50,000 bond was set for Benn, according to the Norfolk Commonwealth's Attorney's Office and the Norfolk Sheriff's Office. If Benn breaks his bond conditions, including visiting Rite Aid drugstores or contacting Colorado's family, he will have to pay the other half of the bond.
Benn is due for an appearance in court in November.
Benn told WAVY.com in a jailhouse interview Colorado had jumped ahead of him in line that afternoon.
"I said 'Excuse me, sir. I'm in line to get my blood pressure medicine.'" said Benn, explaining what he said to Colorado. "[Colorado] said, 'I'm in line too, bro.'"

Benn said at that point, Colorado pepper-sprayed him. Benn said he took out his own gun, Colorado fired at Benn with his gun and shot Colorado. Both men were taken to a hospital where Colorado died and Benn was treated for non-life threatening injuries.
Colorado was well-known in the community under the online alias "Norfolk Dirt," and had worked as a deputy with the Norfolk Sheriff's Office and an auxiliary deputy with the Chesapeake Sheriff's Office, according to a spokesperson with the Norfolk Sheriff's Office. The spokesperson told WAVY.com Colorado was terminated from both positions.
Benn was charged with murder and use of a firearm in the commission of a felony. WAVY.com found Benn's criminal record includes misdemeanor disorderly conduct and traffic violations.
