Repeat DUI offender gets five years

VIRGINIA BEACH, Va. (WAVY) - A man with more than 15 traffic infractions and several DUI convictions was sentenced to five years in prison Wednesday on his fourth DUI offense.

According to Macie Pridgen with the Commonwealth's Attorney's Office, Marlon A. McCall, 38, pleaded guilty last year to his fourth DUI offense and possession of cocaine related to a June 15, 2012 incident. Officers said McCall's eyes were glazed over, his car smelled of alcohol and they found two small bags of cocaine in his pockets.

This incident occurred during McCall's suspended sentences, when he was ordered to be on good behavior from previous DUI offenses. 

Virginia Beach Circuit Court Judge Thomas Padrick sentenced McCall to five years with four years suspended for the June 2012 incident. Additionally, Padrick sentenced him to an additional four years, six months and 345 days in prison for violating his probation.

“McCall is an example of a repeat offender who hasn’t learned his lesson despite three previous DUI convictions,” Virginia Beach Commonwealth's Attorney Harvey Bryant said. “He doesn’t appreciate or fear suspended jail time and he continues to risk the safety of himself and others.”

McCall's record includes convictions for petit larceny, concealed weapon, three counts of driving as a habitual offender and four counts of driving with a revoked license.
