NORFOLK, Va. (WAVY) - A Suffolk man was indicted Tuesday on several charges that lead to the death of a federal witness' death.

According to Peter Carr with the U.S. Attorney's Office, 49-year-old Leroy Scott, Jr. was indicted on charges of conspiracy, witness tampering, retaliation against federal witnesses and use of a firearm resulting in the murder of a witness.

Carr said the witness, Junior Bivins, Jr. was killed in November 2001 in Suffolk. Bivins was set to testify against Scott and his associated regarding drug distribution activities, weapons violations and other offenses. Carr said Scott wanted to retaliate against Bivins and other witnesses.

If he is convicted, Scott could face the death penalty. He will be arraigned Feb. 13.
