Va. court to rehear ex-SEAL case

A Virginia appeals court plans to review the exoneration of a former Navy SEAL trainee in the abduction and murder of a Georgia college student.

The full Virginia Court of Appeals has agreed to rehear the case of Dustin Turner of Bloomington, Ind. No hearing date has been set.

Virginia Attorney General Bill Mims asked for the rehearing last week in a petition that questioned the credibility of fellow trainee Billy Joe Brown, who said he acted alone in killing Jennifer Evans. Mims argued that Brown's two confessions were substantially different, but the trial court only was aware of one.

The appeals panel voted 2-1 earlier this month to clear Turner, agreeing with the trial judge that Brown's confession was credible.
