RICHMOND, Va. (AP) - Virginia's attorney general is asking the full state appeals court to review a three-judge panel's ruling exonerating a former Navy SEAL trainee in the abduction and murder of a Georgia college student.
Bill Mims filed a petition Tuesday asking the Virginia Court of Appeals to rehear the case of Dustin Turner of Bloomington, Indiana. Mims argues that new evidence Turner introduced failed to clear him beyond a reasonable doubt in Jennifer Evans' death.
The petition questioned the credibility of fellow trainee Billy Joe Brown, who said he acted alone in killing Evans. It pointed out that Brown provided two confessions that were substantially different -- but the trial court only was aware of one.
The panel granted Turner a writ of actual innocence earlier this month, affirming a Virginia Beach judge's finding that Brown's confession was credible
