NORFOLK, Va. (AP) - A judge in Norfolk is set to hear defense motions in the case of five Somali nationals accused in an attack on a U.S. Navy ship off the coast of Africa.
The key argument to be heard Thursday in U.S. District Court involves the government's claim that the alleged April 1 attack on the USS Nicholas constituted piracy. Attorneys for the men argue their alleged actions did not rise to that level.
A different judge in the case of another group of Somali defendants tossed out the piracy indictment. A piracy conviction carries a mandatory life sentence.
Another motion to be heard contends the Navy destroyed evidence -- the skiff in which the men allegedly attacked the Nicholas.
